1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.38/2024 registered at Police Station Chippabarod, District Baran for the offence(s) under Sections 8/15 of NDPS Act.

Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated for the offence
[2026:RJ-JP:24372] (3 of 4) [CRLMB-16049/2025] under Section 8/29 of NDPS Act, solely on the basis of the disclosure statement of other co-accused. The recovery of contraband article containing commercial quantity of 174.210 kg of poppy straw was effected from the possession of the other co- accused namely Raghuveer and Bablu and they have already been enlarged on bail. It is further contended that the apart from disclosure statement of the other co-accused Jamnalal, there is no other substantial evidence available on the record connecting the present petitioners in the alleged offence. It is further contended that in the first charge-sheet, the name of the petitioners do not appear, the accused-petitioners are in custody since long and charge-sheet has already been filed and further trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed.
3. Learned Public Prosecutor vehemently opposes the bail application.
4. Heard and perused the material available on record.

Considering the arguments advanced by the learned counsel for the petitioners and more particularly the fact that the co- accused from whom the commercial quantity of contraband were recovered have already been enlarged on bail and apart from the statement of co-accused Jamnalal, who was also accused under Section 8/29 of NDPS Act, there is no other evidence linking the present petitioners with alleged offence, therefore, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

6. Accordingly, the bail applications under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely: 1. Mukesh Meena S/o Murli Manohar, 2. Mukesh Nagar S/o Shankarlal, 3.Rampal S/o Banshilal, 4. Ramdhani W/o Bablu, 5. Manakchand S/o Hajarilal, 6. Rambharose Gadari S/o Prabhulal, in connection with FIR No.38/2024 registered at Police Station Chippabarod, District Baran shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
