1. This revisional application has been filed seeking expeditious disposal of an application for appointment of receiver under Order XL Rule 1 of the Code of Civil Procedure, 1908 filed in Title Execution (Com) 02 of 2024 before the learned Commercial Court at Rajarhat.
2. Mr. Banerjee, learned advocate appearing for the petitioners’ submits that such application has been pending since November 17, 2025.
3. Mr. Mal, learned advocate appearing for the opposite party submits that the opposite party has already vacated the suit premises.
4. Having heard the learned advocate appearing for the petitioners and having considered the material on record, this revisional application is disposed of by requesting the learned Judge, Commercial Court at Rajarhat to dispose of the application for
2 appointment of receiver under Order XL Rule 1 of the Code as expeditiously as possible and preferably on the next date fixed if not earlier.
5. The petitioners submit that there is grave urgency in the matter. In such view of the matter, the petitioner shall be at liberty to make appropriate application before the learned Judge, Commercial Court at Rajarhat for preponement of the date for taking up the said application upon notice to the opposite party. Needless to mention that such application shall be disposed in accordance with law.
6. With the above observations, CO. 1069 of 2026 stands disposed of. There shall be no order as to costs.
7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities
