Judgment / Order 19/06/2026
1. The present bail application has been filed under Section 483 BNSS, 2023 against the order dated 15.04.2026 passed by the learned Sessions Judge, Kotputli-Behror, in Bail Application No. 112/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No. 583/2026 registered at Police Station-Kotputli, District-Kotputli Behror, for the offences under Section 111(2), 111(4), 115(2), 126(2), 140(3), 307, 308(2), 351(2), 61(2)(A) BNS, 2023 and Section 3/25 Arms Act.
2.
Learned counsel for the petitioner contends that the offences are triable by a Magistrate except Section 111 BNS and that the conclusion of the trial is likely to take a considerable amount of
[2026:RJ-JP:23380] (2 of 3) [CRLMB-6312/2026] time. He submits that the challan has already been filed. He further submits that there is only one criminal antecedent. He, therefore, prays that the petitioner be enlarged on bail, particularly in view of the fact that he has remained in judicial custody since 18.12.2025.
4. Learned Public Prosecutor vehemently opposes the bail application.
5. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.
6. Without expressing any opinion on the merits of the case and having regard to the submissions advanced by learned counsel for the parties, and considering the fact that the offences are triable by Magistrate except Section 111 BNS and the challan has been filed and trial will take time, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.
7. Consequently, the bail application is allowed. It is ordered that the petitioner namely-Sandeep Urf Dholaram S/o Amichand arrested in connection with F.I.R. No. 583/2026 registered at Police Station-Kotputli, District-Kotputli Behror, shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/ (Rupees One Lakh Only) with two sureties of Rs.50,000/ (Rupees Fifty Thousand Only) each, subject to the satisfaction of the learned Trial Court, with the stipulation that he shall appear before the said Court on all dates of hearing and as and when called upon to do so until completion of the trial, subject to the following conditions: (i) The petitioner shall not leave country without the permission of the Court;
[2026:RJ-JP:23380] (3 of 3) [CRLMB-6312/2026] (ii) The petitioner shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected; (iii) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
