JUSTICE PRAVEER BHATNAGAR Order 02/07/2026 1. The instant second bail application has been filed under Section 483 BNSS on behalf of the accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 203/2025 registered at Police Station Bhiwadi Phase Trithia, District Bhiwadi for offence under Sections 103(1) of BNS, 2023. 2. Learned counsel for the petitioner submits that the first bail application was dismissed by this Court vide order dated 21.01.2026 with liberty to examine the eye-witnesses, namely, Ramashay Sahani, Sohit, Amit Tanwar, Domi Choudhary, [2026:RJ-JP:24501] (2 of 2) [CRLMB-9661/2026] Lakshaman and Rahul. It is argued that the witnesses have been examined and all the eye-witnesses have turned hostile and not supported the prosecution story. The petitioner is behind the bars since long and further trial/investigation of the case may take considerable time, therefore, the second bail application of the petitioner may be allowed. 3. Learned Public Prosecutor concedes that material eye- witnesses have turned hostile and not supported the prosecution story. 4. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and the fact that petitioner is in custody since long and further trial/investigation of the case may take considerable time, therefore, without commenting on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Roshan Kumar S/o Bachhujha Jha @ Vinodjha, arrested in connection with FIR No. 203/2025 registered at Police Station Bhiwadi Phase Trithia, District Bhiwadi shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
