Chaudhury for the petitioner Manoj Kumar Singha, who has filed this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is behind bars since 20.06.2026 in connection with Nagaon Police Page No.# 2/3 Station Case No. 472/2026 under Section 308(2)/198 of the Bharatiya Nyaya Sanhita, 2023. 2. The allegation against the petitioner is that he has accepted gratification for Postmortem examination of a body relating to a suicidal death. 3. Heard learned Additional Public Prosecutor Mr. K.K. Parashar for the respondent State, who has submitted that this petition with prayer for bail cannot be considered without perusal of the Case Diary. He has raised serious objection stating that the allegation of manipulation of Postmortem report on the “ground of arrest” is a grave allegation which has far reaching consequences. 4. I have considered the submissions at the bar. I have considered the age of the petitioner. I have considered the length of detention. It appears that investigation may have presumably progressed to some extent. Further custodial detention may not be required for the progress of investigation. 5. Considering the entire aspect of the matter, the petitioner is granted bail on furnishing a bail bond of Rs.30,000/- (Rupees Thirty Thousand) with a suitable surety of like amount to the satisfaction of the Jurisdictional Court/Illaqa Magistrate under the conditions that :- (i) the petitioner shall refrain from such activities with which he is alleged, (ii) the petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation, Page No.# 3/3 (iii) the petitioner shall not try to influence the witnesses and, (iv) the petitioner shall not leave the jurisdiction of the Court without prior permission. 6. 6. On breach of any of the bail conditions, the Court is at liberty to cancel the bail granted to the petitioner. 7. In terms of the above observation, this Bail Application stands disposed of.
