The present writ petition has been filed assailing the transfer order of the petitioner along with several others, dated 30.06.2026, whereby, the petitioner, who is posted as Professor in (Anesthesiology) in Government Medical College, Haldwani, District Nainital, has been transferred to Government Medical College, Pithoragarh.

Learned counsel for the petitioner submits that the petitioner has not completed four years at the present place of posting, therefore, the transfer is contrary to the provisions of the Transfer Act, 2017. It is further submitted that the petitioner has several Ph.D. candidates under her and consequently her transfer is contrary to NMC guidelines. 1

In view of the aforesaid submissions, the petitioner is permitted to make a detailed representation to the authorities along with attested copy of the instant order and it is directed that, in case, any such representation is made within a week from today, the same shall decided by the Competent Authority by a speaking order within two weeks. Meanwhile, if no other person has joined the present place of posting of the petitioner, the status quo as on date shall continue till the representation is decided.
4. The writ petition stands disposed of accordingly.
