JUSTICE PRAMIL KUMAR MATHUR Order 03/07/2026 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.177/2026 registered at Police Station Bhawani Mandi, District Jhalawar for offences under Sections 115(2), 126(2), 109(1), 326(g), 125(a), 324(4), 191(2), 191(3) and 190 of BNS, 2023. 2. Heard learned counsel for the petitioners, learned Public Prosecutor as well as counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that the allegations against the present petitioners are [2026:RJ-JP:24766] (3 of 4) [CRLMB-8312/2026] vague and omnibus in nature, without attributing any specific overt act to any individual petitioner. Though the prosecution alleges that seven persons sustained injuries at the hands of the present petitioners, except for the injuries sustained by the injured Sabbaji and Lilabai, all other injuries have been opined to be simple in nature. He further submits that, so far as the grievous injuries sustained by the injured Sabbaji and Lilabai are concerned, the injury to Lilabai is on her right wrist, while the injury sustained by Sabbaji is on right foot. Therefore, having regard to the nature and location of the injuries, the allegations do not warrant a serious view against the present petitioners. Petitioners are behind the bars since 06.05.2026. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently, the bail application of the petitioners may be allowed. 4. Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submissions made on behalf of petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners-Dinesh S/o Vijay Singh, Gopal S/o Prema Lal, Rakesh S/o Parasram, Rahul Banjara S/o Jagdish, Pappu Lal S/o Gordhan, Dara Singh S/o Babulal, Tau S/o Kishan Lal, Vishal S/o Ramesh, Sardar Singh S/o Babulal, Ramesh Lal [2026:RJ-JP:24766] (4 of 4) [CRLMB-8312/2026] S/o Goverdhan, Arjun S/o Vijay Singh, Vikram S/o Jagdish, Arun S/o Babulal, Laxman S/o Sadya and Ram @ Dau S/o Vijay Singh, be released on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
