CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 17.02.2026
01.
1. Heard learned counsels for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Tangi P.S. Case No.22 of 2021 corresponding to G.R. Case No.30 of 2021 pending in the file of learned NGN-cum-J.M.F.C., Tangi on the grounds stated therein.
3. Perused the F.I.R. as at Annexure-1. Referring to the Court’s order in ABLAPL No.1930 of 2021 dated on 16th March, 2022, it is submitted by the learned counsel for the petitioners that the interim order dated 15th March, 2021 not to arrest the petitioners has been made absolute for the reason stated therein. It is informed to the Court that the chargesheet is already filed on 31st March, 2023, hence, the petitioners should be granted the protection against arrest.
4. Recorded the objection of the State. p. 2
5. An offence under Section 307 I.P.C. is alleged with other allied offences having committed by the accused persons including the petitioners. It is also claimed that the injuries received by the victim are not grievous and while claiming so, the medical examination report is produced. The claim is that the petitioners are not the assailants. Upon production of the copy of the medical examination report and on perusal of the same, the Court finds that the victim, namely, Jadumani Sahoo received lacerations stated to be simple in nature with an opinion therein that it might have been caused by hard and blunt object. Considering the above facts and since the interim
order of this Court was made absolute in the ABLAPL
disposed of in the year 2022 and in the meantime, the charge sheet is filed having no serious injury being received by the victim named above, this Court is of the view that the petitioners should be directed to surrender before the learned court below to go on bail with stringent conditions imposed instead of pre-arrest bail, as has been demanded by them.
6. Accordingly, it is ordered.
7. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that upon surrender before the court of learned NGN-cum-J.M.F.C., Tangi within a fortnight from today, the petitioners shall be released on bail in connection with Tangi P.S. Case No.22 of 2021 corresponding to G.R. Case No.30 of 2021 subject to them furnishing bail bonds of Rs.25,000/- (Rupees twenty-five thousand) each with one solvent surety for the like amount each to the satisfaction p. 3 of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the
facts and circumstances of the case.
8. Issue urgent certified copy as per rules.
