Heard both the sides.
The petitioner, above-named is in custody since 11.04.2025 in connection with Jadugora P.S. Case No.23 of 2025 for the offence registered under Sections 69, 126(2), 115(2), 109(1) of the B.N.S., 2023 and under Section 3(2)(va) of the SC and ST (Prevention of Atrocities) Act, 1989 (Amendment Act, 2015). The informant is the victim-lady aged about 30 years and as per the written report lodged on 10.04.2025, it is alleged that she had friendship and intimacy with the petitioner. On the false promise of marriage, physical relationship was established and both were on visiting terms. It is stated that on 09.04.2025, the petitioner called her to a desolate place and on sexual advances being spurned by the victim she was assaulted causing grievous injury.
It is submitted that no offence under Section 69 of BNS, 2023 will be made out as there was consensual physical relationship between two adults. There is no material to show that there was any deception practiced by the petitioner and that he is in custody for more than 8 months.
Learned A.P.P. opposed the prayer for bail. It is submitted that grievous injury has also been inflicted upon the victim. On the pretext of marriage, the victim/ prosecutrix was physically assaulted.
Petitioner and the prosecutrix are adults and appear to be in a long standing consensual physical relationship. Under the circumstance, bail application is allowed and the above- named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like
