HEMALEKHA ORAL ORDER Smt. Padma S. Uthur, learned counsel accepts notice for the respondents. 2. The petitioner has approached this Court seeking a writ of mandamus directing the respondent- BESCOM authorities to restore electricity supply to the petitioner's premises (Consumer ID No.5326609000, RR No. N4LG40094, situated at No.255/P). Brief Facts: 3. The petitioner was allotted 148 square meters of land by the Karnataka Industrial Area Development Board (KIADB) and is in possession of the schedule property adjoining Plot No.255/P in the Peenya 4th Phase Industrial Area. Necessary EHT clearance was obtained - 3 - HC-KAR NC: 2026:KHC:19799 WP No. 11121 of 2026 from KPTCL after inspection in 2012. The BESCOM sanctioned electricity connection after compliance with the conditions, and supply was continued. On 02.03.2026, electricity supply was abruptly disconnected. 4. Learned counsel for the petitioner submits that the disconnection was effected despite payment of dues. It is submitted that no prior notice or opportunity of hearing was given and the action was allegedly at the instance of a private lessee and violates principles of natural justice. 5. Learned counsel for the respondents submits that though discrepancies were noticed, she fairly submits that no prior notice was issued before disconnection. 6. It is evident that the electricity supply disconnected abruptly without issuing prior notice or affording an opportunity of hearing, despite there being no arrears in respect of the electricity charges. Electricity being an essential service, such action cannot be exercised arbitrarily. The action of the respondent is ex facie in - 4 - HC-KAR NC: 2026:KHC:19799 WP No. 11121 of 2026 violation of Section 56 of the Electricity Act, 2003 and principles of natural justice. 7. Accordingly, without adverting to the merits and demerits of the contentions raised by either parties, this Court pass the following: ORDER i. The writ petition is disposed of. ii. The respondent-authorities are directed to restore the electricity supply forthwith to the petitioner’s premises. iii. Liberty is reserved to the respondents to take action, if so advised, in accordance with law. iv. The petitioner shall continue to pay the consumption charges regularly.
