Toppo, GA-V : Mr. Neil Abhijit Toppo, Advocate …...... 02/21.01.2026: By way of filing this writ petition, the petitioner has sought for the following reliefs: i) For direction upon the respondents to pay the scale of Rs. 4000- 100-6000 from the date of his joining on 17.07.2004 as per the appointment letter issued to him vide Memo No. 416 dated 14.07.2004 (Annexure-I) to the post of Clerk. ii) For direction upon the respondents to pay the different arrears of salary to the petitioner with 6% interest thereupon, the petitioner was recommended for appointment as Clerk by the District Compassionate Committee, Chatra vide meeting dated 04.06.2004 in the pay scale of 4000-100-6000 accordingly appointed as Clerk by Civil Surgeon-cum-Chief Medical Officer, Chatra vide Memo No. 416 dated 14.07.2004(Annexure-1) ( 2026:JHHC:1712) 2 iii) For quashing of the Memo No. 508 dated 18.08.2004 (Annexure- 3) whereby after appointment of the petitioner on the post of Clerk in the pay scale of 4000-100-6000 change to Rs. 3050- 4590 against the decision of District Compassionate Appointment Committee, Chatra headed by Deputy Commissioner, Chatra without following the principle of natural justice. 2. It is the case of the petitioner that he has not been granted the pay scale for which he is entitled to. He submits that the representation is pending for disposal before the respondent which has not yet been taken into account. 3. The learned counsel for the respondents submit that if the petitioner files fresh representation before the Director-in-Chief, Health Services, Govt. of Jharkhand, respondent no. 3, along with all necessary documents, his case will be considered, and an appropriate order will be passed as per law. 4. Considering the submission of the parties, I direct the petitioner to file a fresh representationwithin four weeks before the Director-in- Chief, Health Services, Govt. of Jharkhand, respondent no.3.On receipt of the said representation, the case of the petitioner will be considered within six weeks. 5. If it is found that the petitioner is entitled for any relief the same be extended to him within 4 weeks thereafter. Further, if it found that the petitioner is not entitled, the reasoned order should be communicated to him within the aforesaid period. 6. Accordingly, this writ petition is disposed of.
