UKHC010124762026 2026:UHC:6526 1 HIGH COURT OF UTTARAKHAND AT NAINITAL Writ Petition Service Single No. 1903 of 2026 29 July, 2026 Gireesh Kumar --Petitioner Versus Secretary of Education of Uttarakhand Dehradun and others --Respondents ---------------------------------------------------------------------- Presence:- Ms. Jasmeet Kaur, learned counsel for the petitioner. Mr. R.C. Joshi, learned Brief Holder for the State/respondent nos. 1 to 5. ---------------------------------------------------------------------- Hon’ble Pankaj Purohit, J. The petitioner has sought for a writ of mandamus commanding the respondent no.1 to call for the records from the office of respondent no.2, and consider the petitioner’s claim for promotion to the post of Principal along with all consequential service and pensionary benefits in compliance of Government Order dated 26.09.2025. 2. Petitioner, who was working as a Lecturer in the Education department of respondent State was given charge of Principal upon retirement of Shri Satish Chandra Gaur, the Principal from P.M. Shri Adarsh Rajkiya Inter College, Laldhang, Badrabad, Haridwar on 31.03.2025. 3. The petitioner is claiming regular promotion. It reveals from the record that as on date, a regular UKHC010124762026 2026:UHC:6526 2 Principal has joined the institution and the charge of the petitioner as Principal has also been taken. The petitioner claims promotion only on that basis that he was given a duty of In-charge Principal of the Government Inter College. This cannot be a ground to claim promotion. 3. It is further observed that a person has got no right to claim promotion on a particular post; at the most, he has a right to be considered for promotion. The petitioner is retiring on 30.07.2026. No promotional exercise is going on. In such view of the matter, the writ petition is highly misconceived and is dismissed in limine. (Pankaj Purohit, J.) 29.07.2026 Nahid
