GP FOR REVENUE The Court made the following: THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION No.22318 OF 2026 ORDER: 1. The present writ petition is filed challenging the action of the respondent authorities in not considering the application submitted by the petitioners. 2. The learned counsel appearing for the petitioners submits that the petitioners have purchased land admeasuring Ac.3.00 cents in Sy.No.140/3. It is submitted that the said property was initially classified as “Tank Poramboke” vide proceedings dated 04.02.1987 issued by the Settlement Officer, Nellore, and the petitioners were found to be in encroachment of the said poramboke land. 3. The respondents preferred an appeal before the Special Officer, and the same was dismissed vide order dated 13.03.2000. Thereafter, the petitioners filed W.P.No.10988 of 2002 and batch, seeking mutation of their names in the revenue records. The State also filed W.P.No.12928 of 2002. The writ petition filed by the petitioners was allowed and the writ petition filed by the State was dismissed. The writ appeals preferred by the State were also dismissed. Thereafter, S.L.P.Nos.8585-8587 of 2003, preferred by the State, were dismissed on 09.10.2003. 4. Unmindful of the aforesaid proceedings, respondent No.2, vide proceedings dated 24.10.2002, and in pursuance of the orders passed by this Court in W.P.No.26623 of 2001, directed implementation of the orders of the Settlement Officer, Nellore, dated 04.02.1987 in the revenue records, subject to the outcome of the S.L.P. It is submitted that the said S.L.P. was also dismissed on 09.10.2003. 5. However, the respondents continued to retain the subject property in the prohibited list under Section 22-A of the Registration Act. In this regard, the petitioners submitted several representations requesting sub-division of the property and deletion of the extent of Ac.3.00 cents in Sy.No.140/3 of Akkarampalle Village, Tirupati Urban Mandal, from the original pattadar, P. Rukminamma, and also for deletion of the said extent of Ac.3.00 cents from the prohibited list maintained under Section 22-A. It is submitted that no orders have been passed despite several representations submitted by the petitioners. 6. The learned Assistant Government Pleader appearing for the respondents seeks time to obtain instructions. 7. Having considered the orders passed by the Settlement Officer dated 04.02.1987, the subsequent orders passed by the Special Commissioner and Director of Settlements dated 13.03.2000, the orders passed by the Chief Commissioner of Land Administration dated 15.07.2000, the orders passed in W.P.No.10988 of 2002 and batch dated 23.04.2002, the common order dated 25.09.2002 passed in W.A.No.1443 of 2002 and the orders passed in S.L.P.Nos.8585-8587 of 2003 dated 09.10.2003, the case of the petitioners deserves to be considered by the respondents by passing appropriate orders, duly taking into consideration the aforesaid proceedings and the judicial pronouncements rendered by the Courts. 8. With the above observations, the writ petition is disposed off. The respondents are directed to pass appropriate orders, in accordance with law, duly taking into consideration the proceedings of the Settlement Officer dated 04.02.1987, within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
