Petitioner is before this Court seeking for the following reliefs: (a) ISSUE a Writ of Certiorari or any other appropriate writ, order or direction quashing Meeting Notice No. NCMC:STAFF:CR: 02:2025-26 dated 07.02.2026, issued by Respondent No.4 under the instructions of Respondent No.5, convening the meeting of the Nelamangala City Municipal Council scheduled on 11.02.2026, as being illegal, arbitrary and violative of of the Karnataka Municipalities Act, 1964; (ANNEXURE B) (b) ISSUE a Writ of Mandamus or any other appropriate writ, order or direction restraining the Respondents from convening. conducting or proceeding with the said meeting or from transacting any business pursuant to the impugned notice. without strict compliance with the provisions of the Karnataka Municipalities Act, 1964 and the binding resolution of the Municipal Council dated 23.01.2026; (Annexure- A) (c) ISSUE a further Writ of Mandamus directing the Respondents to circulate the agenda, detailed report, explanatory note and all supporting documents relating to the Standing Committee minutes dated 21.10.2025 to all elected Councillors, and to convene any meeting only after complying with the mandatory statutory requirements, (d) PASS such other order(s), direction(s) or relief(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice and equity. 4. Essentially, what the petitioner seeks is for a stay of consideration of one of the agenda items in a meeting to be held at the Nelamangala City Municipal Council. Any particular agenda of a Municipal Council is required to be considered in terms of the applicable law and forms part - 4 - HC-KAR NC: 2026:KHC:8217 WP No. 4305 of 2026 of the democratic process and self-government of the Municipal Council. 5. The petitioner cannot seek for nor can this Court grant, a stay of consideration of any particular matter by the Municipal Council.
