Learned counsel representing the petitioner submits that since the earlier writ petition was dismissed as withdrawn without any liberty to file a fresh writ petition; in view of the judgment of the Hon’ble Supreme Court in the cases of Sarguja Transport Service Vs. State Transport Appellate Tribunal, M.P., Gwalior, & Ors. reported in (1987) 1 SCC 5 and Bharat Sanchar Nigam Limited Vs. Daily Wages Labour Union/Dainik Bhogi Mazdoor Sangh reported in 2025 SCC OnLine SC 1186, and also the judgment of Division Bench of this Court in the case of C.G.G. Construction

through its Proprietor Rajesh Singh Vs. State of Jharkhand through its Principal Secretary, Health Education and Family Welfare Department & Ors. reported in 2023 SCC OnLine Jhar 1810, the petitioner is not pressing this writ petition. However, he is praying for a liberty to avail the alternative remedy.

Accordingly, this writ petition is dismissed as withdrawn, with the aforesaid liberty, subject to maintainability of the alternative remedy and permissibility of the same as per law.
