Sharma, learned Additional Public Prosecutor. 2. This petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely, Abdur Rashid @ Rashid Ali, has prayed for granting pre-arrest bail, apprehending arrest in connection with Jogighopa P.S. Case No. 58/2026, registered under Section 299 of BNS read with Section 13(1) of the Assam Cattle Preservation Act & read with Section 11(1) of Prevention of Page No.# 2/3 Cruelty to Animal Act. 3. It is alleged in the ejahar 07.05.2026, lodged by the in-charge of Jogighopa PS that the house of one Illias Ahmed was searched, upon the information and meat suspected to be beef was seized from the possession and subsequently, he revealed that the petitioner and his father were involved in the said activities. 4. The learned counsel for the petitioner submits that in April 2026 the petitioner met with an accident resulting in multiple fractures and in support of the same he has annexed some medical documents and I have perused the same. Medical prescription dated 18.4.26 indicates injuries due to an accident and the radiological report also indicates fracture. 5. On the other hand the learned Additional Public Prosecutor submits that there are incriminating material the against the petitioner about violating the provisions of the Cattle Act specially Section 8 and the report of the IO which was called for also indicates that such activities were being carried out in areas where these are not permitted. 6. However, I have seen the progress of investigation. Though there are adverse materials implicating the petitioner but considering the progress of investigation and also the aspect of injuries sustained in the accident, I deem it fit to allow this bail petition. 7. Accordingly, it is provided that in the event of arrest of the petitioner, named above, in connection with above mentioned case, they shall be released on furnishing bail bond of Rs.50,000/- with a suitable surety of the like amount, to the satisfaction of the arresting authority. The direction for pre-arrest bail is subject to the conditions that the petitioner: Page No.# 3/3 (i) cooperate with remaining investigation; (ii) Shall not hamper or tamper with the evidence of the case (iii) Shall not indulge in any activities violative of Assam Cattle Preservation Act specially Section. 8. Violation of any of the bail condition shall entail cancellation of bail. 9. Accordingly, this anticipatory bail application stands allowed and disposed of. 10. Return the case diary.
