02/ 05.05.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Jaridih P.S. Case No. 53 of 2024 arising out of Complaint Case No. 896 of 2022 registered under sections 406, 420, 467, 468, 471 of the I.P.C, pending in the Court of learned Additional Chief Judicial Magistrate, Bermo at Tenughat.

Learned counsel for the petitioner submits that petitioner has already executed the sale deed in favour of the informant in the year, 2016 and in the F.I.R allegations are made that possession has not been provided to the informant. He submits that petitioner has got no criminal antecedent which is disclosed in para 21 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of not providing possession to the informant.

Considering that sale deed was already executed in favour of the informant in the year, 2016 whereas F.I.R has been lodged in the year, 2024 that too alleging that possession has not been provided to the informant. The petitioner has got no criminal antecedent which is disclosed in para 21 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Bermo at Tenughat, in connection with Jaridih P.S. Case No. 53 of 2024 arising out of Complaint Case No. 896 of 2022, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
