The challenge in this petition is to an order dated 30th July, 2026 passed by the Executing Court in MACP Darkhast Case No.35/2011 thereby directing issuance of arrest warrant against the petitioner – judgment debtor. 3. On 14th August, 2026, the petitioner preferred an application before the Executing Court (Exh. 121) and prayed for recall of the arrest warrant. The petitioner had shown willingness to deposit a sum of Rs.25,000/- towards part satisfaction of the award. It appears that, the Executing Court has directed the office to accept the sum of Rs.25,000/- towards part satisfaction of the award. However, the Executing Court has not passed any order on the prayer of the petitioner to grant 45 days time to deposit the amount and recall the order of the issuance of arrest warrant. 5. Since the Executing Court has directed the office to accept the amount of Rs.25,000/- towards part satisfaction of the award, it would be expedient that the Executing Court considers the prayers in the application (Exh.121) and passes an appropriate order on the said application. 6. The Executing Court is, thus, requested to pass an appropriate order on the application (Exh.121) as expeditiously as possible and in accordance with law. 7. To facilitate the petitioner to approach the Executing Court and press the prayers in the application (Exh.121), the execution of the arrest warrant issued by order dated 30th July, 2026, shall remain stayed for a period of two weeks. 8.
