2. This writ petition was filed in 2018, seeking the following reliefs:
“Issue a writ, order or direction to in the nature of mandamus commanding / directing the respondent nos.1 to 3 to take the possession of Gram Sabha's public utility land of well situated in Khasra no.174 measuring 0.0020 hectare @ 20.25 Sqr. Mtr. in Village Daluwala Kalan, Pargana Roorkee, Tehsil & District Haridwar from the respondent no.4 and to hand over the same to the petitioner (Gram Sabha), as the respondent no.2 has already passed the eviction
order dated 15-05-2018 against the respondent no.4 (contained as Annexure No.2 to this writ petition) and thereafter the respondent no.2 also issued an execution warrant under CH-49(C) of U.P. Z.A. Act under rule 115(e) on 21-05-2018 (contained as Annexure No.3 to this writ petition).”

Learned counsel for the petitioner submits that petitioner is not aware as to whether possession of the land in question has been handed over by respondent No. 4 to Gaon Sabha.
4. In such view of the matter, the writ petition is disposed of with liberty to petitioner to approach the District Magistrate by making representation, if possession has not been handed over to Gaon Sabha.
5. If he makes representation within three weeks from today, District Magistrate shall pass necessary order thereupon, as per law, within three months thereafter.
