P.P. 02/ 06.05.2026: Heard learned counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Koderma P.S. Case No. 26 of 2026, registered under sections 303(2), 317(5) and 3(5) of BNS, 2023, (corresponding to sections 379, 411 and 34 of I.P.C) as well as Rule- 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, Rules- 4/54 of JMMC Rules and 21 of MMDR Act, pending in the Court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel for the petitioner submits that petitioner happens to be owner of one of the tractor and allegations are made of carrying 100 cft sand on the said tractor. She next submits that driver of the said vehicle has already been granted regular bail. On these grounds, she submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that petitioner is having two criminal antecedents as stated in case diary and impugned order of the learned Sessions Judge and driver of the said vehicle has been granted regular bail and in view of that anticipatory bail of the petitioner may kindly be rejected. Considering that petitioner is having two criminal antecedents and driver of the said vehicle has been granted regular bail and allegations are there that in absence of proper documents sand was being carried, I am not inclined to grant anticipatory bail to the petitioner.
