Rakesh Kainthla, Judge The petitioner has led the present petition for quashing of FIR No. 95 of 2023, dated 22.8.2023, registered at Police Station Dharampur, District Solan, H.P. for the commission of o-ences punishable under Sections 3(1)(r), 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SC/ST Act) and Sections 504 and 506 read with Section 34 of the Indian Penal Code (IPC) and consequential proceedings
2 2026:HHC:75 arising out of the said F.I.R. based on the compromise e-ected between the parties. 2. It has been asserted that the petitioner and respondent No.2/informant have settled their dispute and executed a compromise deed. The informant is working with Mohit Sateja, who is closely related to Brijesh Kharbanda, and the petitioner is a partner of Brijesh Kharbanda. Many cases were led by the parties against each other. Now the dispute has been settled, and they want to withdraw the cases led by them to maintain cordial relation between them. Hence, the petition. 3. Statement of the informant, Vijay Laxmi, was recorded on 18.8.2025, in which she stated that the matter was reconciled between the parties without any in=uence or coercion from any person, and she had no objection in case the FIR was ordered to be quashed based on the compromise. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. Sections 504 and 506 of IPC are compoundable under Section 320 of Cr.P.C. Section 320(3) Cr.P.C. provides that when the o-ence is compoundable under this Section, and the accused is
3 2026:HHC:75 liable under Sections 34 or 149, the o-ence may be compounded. Therefore, the o-ences punishable under Sections 504 and 506 read with Section 34 of the IPC can be compounded under Section 320 of Cr.P.C.
6. This Court has already quashed the F.I.R. registered for the commission of o-ences punishable under Section 3 of the SC & ST Act in Rasik Sharma Vs. State of H.P. 2024 STPL 8598 HP, Krishan Lal and others Vs.
State of HP and others, 2022 STPL 10793 HP, Satish Kumar and Others Vs. State of HP and others 2022 STPL 10703 HP, Vinod Kumar & Ors. Vs. State of HP and others, 2017 STPL 10679 HP, and Lalit Singh and others Vs. State of HP and others, Cr. MMO No. 326 of 2016-Decided on 17.04.2017 based on compromise. These judgments are binding on this Court. 7. Therefore, in view of these precedents, the present petition is allowed and FIR No. 95 of 2023, dated 22.8.2023, registered at Police Station Dharampur, District Solan, H.P. for the commission of o-ences punishable under Sections 3(1)(r), 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SC/ST Act) and Sections 504 and 506 read
4 2026:HHC:75 with Section 34 of the Indian Penal Code (IPC) and consequential proceedings arising out of the said F.I.R. are quashed. 8. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 9. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certied copy, but if required, may verify passing of the order from the Website of the High Court.
