This is the First bail application 昀椀led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 304/2024 registered at Police Station – Devendra Nagar, District Raipur (C.G.), for the o昀昀ence punishable under Section 20(b)(ii)(c) of the Narcotics Drugs and Psychotropic Substances Act. 2. As per the prosecution case, based on secret information, the police recovered a total of 50.100 kg of cannabis (ganja) from the possession of the present applicant and other co-accused. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case and the alleged contraband article i.e. 50.100 Kgs of was not seized from the joint possession of the present applicant and other co-accused person. He also submits that the present applicant has no criminal antecedents and he is in jail since 14.09.2024, and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that in the present matter the charge- sheet has been submitted before the competent Court. She further submits that the bail applications of other co-accused persons, namely, Umakant Mahanand, Devid Nanda and Kuber Mahanand @ Raja have already been rejected by this Court in MCRC No. 2254 of 2025, MCRC No. 2915 of 2025 and MCRC No. 4145 of 2025, vide orders dated 17.04.2025, 28.04.2025 and 29.05.2025 respectively, therefore, the bail application of the present applicant is also entitled to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and the fact that the bail applications of other co-accused persons, namely, Umakant Mahanand, Devid Nanda and Kuber Mahanand @ Raja have already been rejected by this Court in MCRC No. 2254 of 2025, MCRC No. 2915 of 2025 and MCRC No. 4145 of 2025, vide orders dated 17.04.2025, 28.04.2025 and 29.05.2025 respectively on merits, therefore, the bail application of the present applicant is also entitled to be rejected. 7. Accordingly, the bail application of the applicant – Shankar Chhatria, 昀椀led under Section 483 of the BNSS, involved in Crime No. 304/2024 3 registered at Police Station – Devendra Nagar, District Raipur (C.G.), for the o昀昀ence punishable under Section 20(b)(ii)(c) of the Narcotics Drugs and Psychotropic Substances Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
