GP FOR ENDOWMENTS The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.24532 OF 2026 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of eviction order dated.24.07.2026 passed by the 4th respondent/competent Endowments authority in respect of the petition schedule temple land situated at Sy.No.149 Admeasuring to an extent of Ac.5.47 cents, Mudigedu Village, Podalakur Mandal, SPSR Nellore District, and set aside the same as being illegal, arbitrary, violation of the principles of natural justice, contrary to earlier orders of this Honble court and contrary to the procedure contemplated under section 83 of Andhra Pradesh charitable and hindu religious institutions and endowment act,1987 and consequently direct the respondents not to dispossess or interfere with the petitioners possession except by strictly following the procedure established by law and after affording the petitioner due notice and reasonable opportunity of hearing and pass such other order or orders.…” 2. Heard learned counsel for the petitioner and learned counsel for respondents. 3. The petitioner has challenged the proceedings in Rc.No.Nil/2026, dated 24.07.2026, wherein the petitioner was directed to evict from the land admeasuring Ac.3.59 cents and Ac.5.47 cents in Sy.No.410, 149 respectively in Mudigedu Village. 4. Learned counsel for respondents submits that against the impugned proceedings, an alternative remedy is available to the petitioner under Section 87 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 (hereinafter for short ‘the Act’) and urged this Court to 4 direct the petitioner to avail alternative remedy. Learned counsel further submits that prior to filing of this writ petition, the petitioner filed W.P.No.20541 of 2026, and this Court disposed of the same, directing the respondents to following due process of law before evicting the petitioner. Accordingly, the respondents issued notice and passed the impugned order. 5. In view of the said submissions, the present Writ Petition is disposed of, directing the petitioner to avail alternative remedy as provided under the Act. However, the respondents are directed not to take any coercive steps for a period of three weeks from today.
