Sarma, learned counsel for the petitioner. Also heard Mr. G. Khandelia, learned counsel for the respondent. [2.] This application under Section 24 of the Code of Civil Procedure, 1908 has been filed by the petitioner, Smti. Nandini Sureka, praying for transfer of Page No.# 2/3 matrimonial case bearing T.S.(M) Case No. 18 of 2025, which is presently pending before the Court of the learned District Judge, Charaideo to the Court of Principal Judge, Family Court, Kamrup (M) at Guwahati. The learned counsel for the respondent has submitted that he has been instructed by the respondent not to oppose the prayer and he has no objection, if the aforementioned case is transferred to the Court of learned Principal Judge, Family Court, Kamrup (M), Guwahati as prayed for by the petitioner. [3.] Considering the submissions made by learned counsel for the respondent and the fact that the respondent is not opposing the prayer as well as the fact that the Court of Principal Judge, Family Court, Kamrup (M) also has jurisdiction to entertain the aforesaid matrimonial dispute, the Title Suite (M) Case No. 18 of 2025, which is presently pending before the Court of learned District Judge, Charaideo, is hereby transferred to the Court of learned Principal Judge, Family Court No. I, Kamrup (M) at Guwahati. The learned District Judge, Charaideo is directed to send the records of the aforesaid Title Suit, so as to reach the Court of Principal Judge, Family Court, Kamrup (M) at Guwahati on 02nd of March, 2026. [4.] Since both the parties are represented by their engaged counsels before this Court, both the parties are directed to appear before the Court of learned Principal Judge, Family Court No. I, Kamrup (M) at Guwahati in the aforesaid case on 16th of March, 2026. [5.] The learned counsel for the respondent has prayed for allowing the respondent to appear in the aforesaid proceeding through video conferencing, considering the ailment of his father. [6.] Since the matter has been transferred to the Court of the learned Principal Page No.# 3/3 Judge, Family Court No. I, Kamrup (M), the said prayer shall be considered by the Trial Court as and when such prayer is made by the respondents.
