In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kaliganj Police Station Case No.678 of 2025 dated 16.08.2025 under Sections 20(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985;
Samsul Sk Versus The State of West Bengal
Mr. Ali Ahsan Alamgir Ms. Soma Mal Ms. Rabia Khatoon Ms. June Modak. …for the petitioner.
Mr. Arijit Ganguly Mr. Nirupam Dhali. …for the State.
Report submitted by the State be kept with the record.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 47 days and the subject matter of the case involves recovery of 477 grams of heroin. Petitioner submits that the petitioner has been implicated on the basis of the statement of the co-accused.
Learned advocate for the State opposes the prayer for bail and submits that there was continuous communication between the present petitioner and the principal accused. The number of calls which have been reflected in the report is abnormal.
As such, at this stage, I am not inclined to release the petitioner on bail.
