The applicants who are in custody since 15.07.2025 have approached this Court for grant of regular bail in connection with Dandai P.S. Case No. 14 of 2025 for the offence registered under Section 126(2), 115(2), 117 (2), 109, 352, 351(2), 351(3)/3(5) of B.N.S, pending in the Court of J.M. 1st Class, Garhwa. 3. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosures have been annexed with this bail application and there is no suppression on his/her part. 4. Earlier the anticipatory bail application of the applicants was dismissed as withdrawn vide order dated 20.06.2025 in A.B.A. No. 2808 of 2025. Thereafter, regular bail application of the applicants was also dismissed as withdrawn vide order dated 25.09.2025 in B.A. No. 8416 of 2025. 5. It appears that the main accused namely Vikash Yadav has already been granted regular bail by a co-ordinate Bench of this Court in B.A. No. 4816 of 2025 vide order dated 19.06.2025. It has been submitted that the present applicants have been roped in because they are the family members. The applicants are old aged person. 6. Learned A.P.P. has opposed the prayer for bail of the applicants. 7. Considering the materials available on record and the fact that the main assailant Vikash Yadav has already been granted regular bail by a co-ordinate Bench of this Court, I am inclined to enlarge the applicants 2026:JHHC:485 2 B.A. No. 9915 of 2025 on bail. Accordingly, the applicants, named above, are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Garhwa in connection with Dandai P.S. Case No. 14 of 2025, subject to condition that the applicant(s) will submit self- attested photocopy/photocopies of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the learned trial court which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court and he is directed to report once in a month to the concerned police station.
