After arguing the matter for some time, learned counsel for the petitioner, based on instructions, seeks leave to withdraw the present writ petition with liberty to file a civil suit. 3. He submits that the petitioner was bona fide in pursuing this writ petition since September, 2022 in this Court and therefore if at all any issue of limitation will arise, it may be protected. 4. Leave is granted with liberty as prayed for. 5. All contentions of the parties are specifically left open for determination by the Civil Court, should the petitioner institute a suit for redressal of its grievances. 6. If the petitioner files a suit, the period between 13.09.2022 and the date of disposal of the present writ petition i.e., today may be excluded for determining the limitation period.
