The present writ petition has been filed for the following relief:- “For direction upon the respondents for consideration the deciding and objection regard to the of petitioner with regard to unfair and illegal determination of amount of compensation in respect of acquisition of 4.7 decimal commercial land of the petitioner situated at plot no. 443 (old plot no. 433), khata no. 69 (old khata no. 21) Mouza-Kusmatand, Mouza No. 177, P.S.-Govindpur, Dist.-Dhanbad as the said land has been acquired by the respondent for four lining and widening project of National Highway no. 419 from Govindpur to Pokharia Section.” 2. The description of land has been disclosed in para-6 of the writ petition, which is quoted hereinbelow:- “Land measuring area 22.87 decimals situated at Plot No.443 (Old Plot No.433), Khata No.69 (Old Khata No.21) Mouza-Kusmatand, Mouza No.177, P.S.-Govindpur, Dist.-Dhanbad” 3. It has been claimed that she is an awardee and award amount has been released but she is not satisfied with the quantum of award. Accordingly, she prays for enhancement. 4. The operating law in the field is Section 3G(5) of the National Highways Act, 1956 which reads as under:- 2026:JHHC:1759 2 W.P.(C) No.7828 of 2025 Section 3G(5)-If the amount determined by the competent authority under sub-section (1) or sub-section (2) is not acceptable to either of the parties, the amount shall, on an application by either of the parties, be determined by the arbitrator to be appointed by the Central Government. 5. Thus, the operating law provides Forum for settlement of the claim as claimed by the petitioner. 6. In that view of the matter, the present writ petition stands disposed of giving liberty to the petitioner to approach the authority along with the present order. If any such application is made, the authority is directed to refer the matter for adjudication as per the mandate of above section. 7.
