Mr. Prabir Majumder …for the petitioner Mr. Abishek Sinha, Mr. Tirupati Mukherjee … for the State Learned counsel appearing on behalf of the petitioner submits that there was a scuffle between two sides regarding a property dispute. Both the sides received injuries. But, none was grievous in nature. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the statement of a victim and the statements of other witnesses. He refers to the injury report, where the petitioner’s name has been taken as an assailant. The victim was assaulted on different parts of the body including face and a tooth was broken. Considering the above and the other materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. 2 Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
