Petitioner presented a suit claiming that his marriage with the respondent do not subsist anymore, in view of Triple Talaq given by him. He relied upon a Talaqnama in support of his contention. 3. Learned Additional Judge, Family Court, Roorkee declined to entertain the suit filed by petitioner by observing that there is no reference to the Triple Talaq in the Talaqnama. Thus, feeling aggrieved by order dated 14.08.2018, passed by Additional Judge, Family Court, Roorkee, petitioner has filed this writ petition. 4. Perusal of the order-sheet reveals that on 08.10.2018, Registrar (Judicial) directed that defects be cured on or before 10.10.2018. Thereafter, the matter was listed before Registrar (Judicial) on two more dates i.e. 10.10.2018 & 12.10.2018, but, defects were not removed. Thereafter, the matter was listed before Coordinate Bench on UKHC010157632018 2026:UHC:6424 23.10.2018 and again a week’s time was given to petitioner for curing the defects. Defects have not been cured so far. 5. Having regard to the averments made and documents enclosed with the writ petition, this Court do not find any reason to interfere with the order passed by learned Family Court. The Talaqnama relied upon by petitioner is absolutely silent regarding Triple Talaq given by petitioner. 6. Thus, there is no scope for interference in the matter. The writ petition is dismissed.
