Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R. Case No.32 of 2026 pending in the file of learned S.D.J.M., Kamakhya Nagar arising out of Kamakhya Nagar P.S. Case No.20 of 2026 on the grounds stated. 3. Gone through the FIR as at Annexure-1. From Annexure-2, it is made to reveal that the dispute is between the informant and the co-accused, namely, Amaresh Prasad Roul. The petitioner works under the said accused as an employee. The allegation is that theft has been committed in respect of gas tanks and other articles from the alleged premises. But having regard to the fact that the informant is having a dispute with the other accused and there has been a settlement claimed as per Annexure-2, this Court is of the view that in absence of any specific complaint against the petitioner and he being an employee under the other accused named above, this Court though not inclined to grant him pre-arrest bail but is of the view that he should be directed to surrender before the learned court below for being released on bail with suitable conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned S.D.J.M., Kamakhya Nagar within a fortnight from today, it is directed that he shall be released on bail in connection with G.R. Case No.32 of 2026 corresponding to Kamakhya Nagar P.S. Case No.20 of 2026 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed by the court concerned as deemed just and proper and in the facts and circumstances of the case besides the following, such as, he shall cooperate the I.O in the investigation, till the same is over. 6.
