JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:14671 WP No. 8226 of 2026 ORAL ORDER The present writ petition is filed seeking the following prayer: "Wherefore the petitioners pray that this Hon'ble court may be pleased to issue: a) A writ in the nature of mandamus or any other appropriate order. direction, as to direct the respondent bank to return the original documents furnished by the petitioners at the time of borrowing the loan, Since the petitioners are ready and willing to pay the loan amount as per the letter dated 07-08-2024 vide ANNEXURE-J. b) A writ in the nature of certiorari or any other appropriate order, direction as to quash the notice dated 7-2-2026 published in kannada newspaper "Kannada Prabha" vide ANNEXURE-L. c) Grants such other writ, order or direction as this Hon'ble court may deems fit and proper under facts and circumstances of the case including the award of cost in the interest of justice and equity." 2. Learned Counsel for the petitioners submits that the petitioners are ready to pay an amount of Rs.15,00,000/- but respondent/Bank is demanding one crore and odd. 3. All these disputed questions of fact cannot be decided by this Court in a writ petition. If the petitioners had paid the amount and respondent/Bank was not releasing the title deed, that would be a different cause of action. If there is any dispute with regard to the amount, they have to question - 4 - HC-KAR NC: 2026:KHC:14671 WP No. 8226 of 2026 the same, but they cannot come before this Court by seeking a prayer of this nature. 4. In that view of the matter, this Court is passing the following: ORDER i. Accordingly, the writ petition is disposed of giving liberty to the petitioners to avail the appropriate remedy. ii.
