Protyush Rajkonwar, who have filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail as they are
Page No.# 2/2 apprehending arrest in connection with Dispur Police Station Case No. 357/2026 under Sections 132, 3(5), 79 and 121 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
2. Heard Mr. K.K. Parashar, learned Additional Public Prosecutor for the respondent State.
3. The allegation is basically against Bikash Sah and Dulumaina Patir, that they have deterred the police officers from discharging their duties. It is submitted that the present petitioners are innocent and their names have not mentioned in the FIR.
4. I have considered the submissions at the bar with circumspection. I have also scrutinized the Case Diary. It appears that anticipatory bail may be granted to the petitioners.
5. In the event of their arrests, the petitioners, 1. Gyanam Jyoti Saikia and 2. Protyush Rajkonwar, shall be enlarged on bail on furnishing a bail bond of Rs.30,000- (Rupees Thirty Thousand) each with a suitable surety of like amount to the satisfaction of the arresting authority.
6. In terms of the above observation, this Anticipatory Bail application stands
disposed of.
