Learned advocate appearing for the petitioners submits that subject-matter of the case relates to alleged recovery of 206 bottles of Broncof-C (cough syrup) and petitioners are in custody for 6 months 13 days and after submission of charge-sheet, charges have already been framed. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the subject-matter of the case and the fact that prosecution has relied upon 12 charge-sheeted witnesses in order to prove its case. Having considered that time will be consumed in completing the trial, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. 2 Accordingly, the petitioners viz., 1. Mosaraf Sk and 2. Maksur Mondal shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act-cum- Additional District and Sessions Judge, 2nd Court, Berhampore, Murshidabad. If on bail, the petitioners shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 180 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
