The petitioner is apprehending his arrest in connection with Seraikella PS Case No.101 of 2025, corresponding to GR Case No.750 of 2025, for offence registered under section 318(4), 338, 336(3), 340(2), 274, 275 of BNS, 2023 and Sections 47(a), 47(d), 47(f) and 55 of Excise Act, pending in court of learned Chief Judicial Magistrate, Seraikella. 3. Learned counsel for petitioner submits that earlier the petitioner has moved before this Court in ABA No.478 of 2026 which was dismissed as withdrawn with liberty to the petitioner to file regular bail. He next submits that on the fresh ground, the anticipatory bail may kindly be granted to the petitioner. 4. Learned State counsel opposes prayer and submits that on merit the case was considered and thereafter the petitioner has withdrawn that anticipatory bail application earlier and there is no fresh ground to entertain the present anticipatory bail application and in view of that, the anticipatory bail to the petitioner may kindly be rejected. 5. Considering that the earlier anticipatory bail application was filed by the petitioner and the same has been withdrawn in ABA No.478 of 2026 with liberty to move before the learned court by way of filing regular bail petition. 6. In absence of any fresh ground in the instant application, the instant anticipatory bail application is not maintainable and as such, this petition is, hereby, dismissed.
