Heard Mr. M. Islam learned counsel for the petitioner. Also heard Ms. D. D. Barman, learned Additional Senior Government Advocate appears for the Respondents, Ms. M. D. Bora, learned Standing Counsel appears for respondent No. 2. 2. The petitioner was serving under the Assam Co-operative Jute Mill Ltd. Silghat as a Junior Assistant in the Labour Welfare Office. The petitioner was dismissed from service by an order dated 16.07.2025. Being aggrieved, the petitioner has approached this Court challenging the dismissal order. 3. Section 2 A of the Industrial Disputes Act, 1947 provides that where any employer discharges, dismisses, retrenches or otherwise terminates the services of an individual workman, any dispute or difference between that workman and his employer connected with, or arising out of, such discharge, dismissal, retrenchment or termination shall be deemed to be an industrial dispute notwithstanding that no other workman nor any union of workmen is a party to the dispute. 4. Also Section 2 A (2) of the Industrial Disputes Act, 1947 provides that any
Page No.# 3/3 such workman as is specified in sub-section (1) may, make an application direct to the Labour Court or Tribunal for adjudication of the dispute referred to therein after the expiry of forty-five days from the date he has made the application to the Conciliation Officer of the appropriate Government for conciliation of the dispute. 5.
In view of the specific provisions, the petitioner is permitted to withdraw this present writ petition and pursue his remedy in the appropriate forum specified under Section 2A of the Industrial Disputes Act, 1947. 6. Accordingly, this writ petition stands dismissed without expressing any opinion on the merit. JUDGE Comparing Assistant
