The petitioner is apprehending his arrest in connection with Mihijham P.S. Case No. 70 of 2023, registered for the offence under Sections 420 and 506 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1st Class, Jamtara. 3. Learned counsel appearing for the petitioner submits that the petitioner has developed a land on which the flats have been constructed. He further submits that two agreements have been entered into for sale to the informant and one of the sale deed has already been executed with regard to one of the flat. He next submits that so far the second flat is concerned, the original person, who has entered into to the agreement to purchase the said flat, has left for his heavenly abode and his legal heirs and successors are obtaining the succession certificate and once that will be done, the second flat will be authorized to the legal heirs and successors. He next submits that the petitioner is having no criminal antecedent as disclosed in para 22 of the petition. 4. Learned counsel appearing for the State has opposed the prayer and submits that the allegations are there of not registering one of the flat in favour of the purchaser. 5. Considering that the petitioner has already executed sale deed with regard to one of the flat and for the another flat, it has been pointed out that the petitioner will register the said flat in favour of the 2026:JHHC:13259 legal heirs and successors of the person once they will obtain the succession certificate and the petitioner is having no criminal antecedent as disclosed in para 22 of the petition, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamtara, in connection with Mihijham P.S. Case No. 70 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Anit Uploaded 07.05.2026
