The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.195/2025, registered at Police Station Darima, District- Sarguja, (C.G.) for alleged commission of offence punishable under Sections 65(1) of the B. N. S. and section 4(2), 5(h), 5(i), 06 of POCSO Act, 2012. 4. Case of the prosecution, in brief, is that the complainant/victim has made complaint to the concerned police station alleging that the applicant has committed sexual intercourse with her at several places in several times on pretext of marriage since last 06 months. Based upon such complaint, the police station has registered the offences under section 65(1) of the B. N. S. and section 4(2), 5(h), 5(i), 06 of POCSO Act, 2012 against the applicant. 5. Learned State counsel opposes the prayer for grant of anticipatory bail and she would submit that as per the 183 BNSS statement of the victim, it goes to show that she was enticed away by the applicant on the pretext of marriage, thereafter physical relationship was established and she became pregnant and was carrying a pregnancy of seven months, as the victim is a minor, therefore the applicant is not entitled for grant of anticipatory bail. 6. I have perused the case diary. 3 7. From perusal of the statement of the victim recorded under Section 183 BNSS goes to show that the victim was enticed away by the applicant on the pretext of marriage, thereafter physical relationship was established and she became pregnant and was carrying a pregnancy of seven months, as the victim is a minor, therefore I am not inclined to grant anticipatory bail to the applicant. 8. Accordingly, the anticipatory bail application of the applicant - Kartik Das, involved in Crime No.195/2025, registered at Police Station Darima, District- Sarguja, (C.G.) for alleged commission of offence punishable under Sections 65(1) of the B.N.S. and section 4(2), 5(h), 5(i), 06 of POCSO Act, 2012 is rejected.
