The petitioner is apprehending their arrest in connection with Petarwar P.S. Case No. 130 of 2024, registered for the offences under Sections 189(2), 190, 121(1), 132 and 352 of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned S.D.J.M., Bermo at Tenughat.

Learned counsel appearing for the petitioner submits that in a road accident, one person has died, pursuant to that agitations were made by the villagers and further it has been alleged that they have obstructed the public servants in discharging their official duty and the co-accused has been granted anticipatory bail in ABA No.1173 of 2026.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there to obstruct the public servants from discharging their official duty.

Considering that agitations were being made arising out of a road accident, in which, one person has died and further there are general and omnibus allegations against all the accused persons and the co-accused persons have been granted anticipatory bail in ABA No.1173 of 2026, and in that view of the matter, I am inclined to grant anticipatory bail, as such, the petitioner, named above, in the event of his surrender/arrest, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned S.D.J.M., Bermo at Tenughat, in connection with Petarwar P.S. Case No. 130 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
