By way of this writ petition, the petitioners have inter alia prayed for the following reliefs:-
“I. To count the past continuous service rendered by the Petitioners rendered on part time & daily wage basis w.e.f. 16.12.1989 to 01.10.2013, towards qualifying service for pension and other retiral benefits. II. To bring the petitioners under the purview of CCS (Pension) Rules, 1972 and GPF Scheme and declare that the petitioners are entitled to the benefits of pension under the old Pension Scheme.

III. The respondents may kindly be directed to regularize the services of the Petitioners from the due date i.e.01.01.2012 and/or on completion of eight years of service in accordance with the regularization policy in vogue and/or from the prior date when the juniors were regularized in the respondent department. IV. That the respondents may also be directed to grant the consequential benefits qua the conferment of work charge status to the petitioners w.e.f. 27.02.2004 and for their regularization w.e.f. 01.01.2012 or on prior date i.e. on completion of 8 years of daily waged service including entire arrears, pension, seniority, increments etc. to which the Petitioners are entitled.”

When this case was taken up for consideration, learned Counsel for the petitioner has drawn the attention of the Court to the judgment dated 04.06.2025, passed by Hon’ble Division Bench of this Court in CWPOA No. 6676 of 2020, titled as Krishan Lal vs. State of H.P. and others and submitted that the reliefs being prayed for by the petitioners are now squarely covered by the said
judgment.

Having perused the averments made in the writ petition as also the contents of the judgment being relied upon by learned Counsel for the petitioners, this Court concurs with the submissions

so made by learned Counsel for the petitioners that indeed the issue raised by the petitioners is squarely covered by the above referred
judgment of Hon’ble Division Bench of this Court. This fact could also not be disputed by learned Additional Advocate General, though he submitted that he is not aware as to whether the judgment has attained finality or not or the State has taken a call to challenge the same.

In the light of the fact that the issue raised in this petition is squarely covered by the judgment being relied upon by
learned Counsel for the petitioners, this petition is allowed and
disposed of with the direction that the directions passed by Hon’ble Division Bench of this Court in CWPOA No. 6676 of 2020, titled as Krishan Lal vs. State of H.P. and others, shall be construed to have been passed in the present petition also and the petitioners herein shall be entitled to all the benefits as stand conferred by Hon’ble Division Bench in abovementioned case to the petitioner therein. This, of course, shall be subject to legal rights of the respondents to assail the judgment in accordance with law, if so advised. Pending miscellaneous applications, if any, also stand
disposed of accordingly.
