JUDGMENT & ORDER (ORAL) Date:-03-03-2026 Heard Mr. Pfosekho Pfotte, learned counsel for the petitioner. Also heard Mr. N. Angami, learned State counsel for the State respondents.

The petitioner has filed the present application seeking for a direction to the respondent authorities to pay/release the pending contractual bills amounting to Rs. 3,81,000/- (Rupees Three Lakhs Eighty One Thousand) with interest on account of the execution of work of construction of Guest House at Tobu, Mon, Nagaland in terms of the Tender dated 06.04.2004.
3. It is the case of the petitioner that the petitioner was awarded work for construction of Guest House at Tobu, Mon by the Order dated 20.12.2004 pursuant to the NIT dated 06.04.2004. The petitioner claims to have executed the work in terms of the conditions stipulated in the work order to the satisfaction of the respondent authorities. The respondent authorities inspected the work executed by the petitioner and on being satisfied issued the Completion Certificate on 21.03.2009, certifying that the petitioner
Page No.# 3/4 had completed the work as per the specification, with the observation that the necessary payment may be made to the petitioner. The total amount for the said work was Rs. 35,33,166/- (Rupees Thirty Five Lakhs Thirty Three Thousand One Hundred Sixty Six). The respondent authority had already paid the bills, except for the remaining amount of Rs. 3,81,000/- (Rupees Three Lakhs Eighty One Thousand).

It is contended by Mr. Pfosekho Pfotte, learned counsel for the petitioner that despite repeated approaches, the respondent authorities have failed to release the remaining admitted outstanding amount of Rs. 3,81,000/- (Rupees Three Lakhs Eighty One Thousand) to the petitioner which has caused undue hardship, therefore, he submits that the respondent authorities may be
directed to release the admitted amount of Rs. 3,81,000/- (Rupees Three Lakhs Eighty One Thousand) to the petitioner forthwith.
5. Mr. N. Angami, learned State counsel submits that although a communication had already been made to the respondent authorities for instructions, he is yet to receive the required instructions from the respondent authorities. He submits that since the claim of the petitioner is for payment of Rs. 3,81,000/- (Rupees Three Lakhs Eighty One Thousand) for the work which the petitioner is stated to have executed, and the petitioner having been paid the major bill amount, the respondent authorities may be directed to verify the claim of the petitioner of the remaining amount, by providing a timeline.

Having considered that the claim of Rs. 3,81,000/- (Rupees Three Lakhs Eighty One Thousand) for payment to the petitioner on account of the execution of work for construction of Guest House at Tobu, Mon and the major bill amount having been paid to the petitioner and also considering that the petitioner appears to have completed the aforesaid work in terms of the work order, for which the Completion Certificate has been issued by the Additional Deputy Commissioner, Mon, I deem it appropriate to dispose of this writ petition with a direction to the respondent authorities to verify the claim of the petitioner within a period of 2 (two) months, and in the event the claim of the petitioner of the amount of Rs. 3,81,000/- (Rupees Three Lakhs Eighty One Thousand) is found to be undisputed and liable to be paid to the petitioner, as remaining bill amount for construction of Guest House at Tobu, Mon, the respondent authorities are directed to release the payment of Rs. 3,81,000/- (Rupees Three Lakhs Eighty One Thousand) to the petitioner within a period of 30 (thirty) days thereafter. It is hereby
directed, accordingly.
