In this writ application, the petitioner has prayed for a direction upon the respondents to register an FIR against 8 mining lease holders, who after forging the certificate of District Mining Officer, Pakur in connivance with the officials of State Level Environment Impact Assessment Authority (SEIAA), Jharkhand have got the environment clearance for doing mining thereby committing offence punishable under the provisions of BNS as well as the provisions of Environment (Protection) Act, 1986 and the Rules made thereunder. It has been submitted by Mr. Gaurav Raj, learned AC to AAG II that pursuant to the complaint made by the petitioner, the licence granted to the said 8 mining lease holders have been cancelled. It has further been submitted that the Additional Superintendent of Police, Anti-Corruption Bureau, Ranchi has made correspondence with the Principal Secretary, Cabinet Secretariat and Vigilance Department, Government of Jharkhand, Ranchi vide letter no. 582 dated 02.09.2025 seeking permission for registration of preliminary inquiry against the mining lease holders. It has further been submitted that once the permission is granted to register a preliminary inquiry by the concerned -2- department, the inquiry shall be accordingly initiated. Mr. Gaurav Raj, learned AC to AAG II appearing for the State has submitted that he had taken instruction today itself and the said correspondence has not been acted upon as yet by the Principal Secretary, Cabinet Secretariat and Vigilance Department, Government of Jharkhand, Ranchi. In view of the submission made by the learned counsel for the State and the averments made in the respective affidavits, any further progress is dependent on the permission for registration of a preliminary inquiry. Accordingly, this writ application stands disposed of with a direction to the Principal Secretary, Cabinet Secretariat and Vigilance Department, Government of Jharkhand, Ranchi to consider and act on the letter no. 582 dated 02.09.2025 seeking permission for registration of preliminary inquiry within a period of 4 weeks from the date of receipt/production of a copy of this order.
