(2) According to petitioner, post of Lecturer (Mathematics) fell vacant in Govind Ballabh Pant Inter College, Bhowali, Nainital in the month of April, 2026. An application was sent to Chief Education Officer, seeking permission to advertise that vacancy, however, permission has not been granted so far. By means of this writ petition, petitioner has sought the following reliefs: “a) Issue a writ order or direction in the nature of Mandamus commanding and directing the respondent no. 5 Chief Education Officer Nainital to strictly grant permission/approval to the petitioner for publishing the advertisement for filling up the vacant sanctioned post of lecturer mathematics in the petitioner institution without any further delay. b) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent no. 5 Chief Education Officer Nainital to consider and decide the pending application dated 29.4.2026 UKHC010131652026 2026:UHC:6449 (Annexure 2 pg 20-26 to writ petition) and reminder dated 10.7.2026 and 15.7.2026 (Annexure 5&6 pg 30-31 to writ petition) moved by the petitioner by passing a reasoned and speaking order within specified time period, which this Hon’ble Court may deem fit and proper in view of facts and circumstances of the case.” (3) Having regard to the fact that petitioner’s application is pending consideration since 29.4.2026, writ petition is disposed of with direction to Chief Education Officer concerned to take decision on petitioner’s application, as per law, within six weeks from the date of presentation of certified copy of this order.
