(2) Petitioner was employed against a Group C post in Department of Food and Civil Supplies and he retired from service on 31.7.2020. Since pension and other retiral dues have not been released to him so far, therefore, he has filed this writ petition seeking the following reliefs: “A. Issue a writ, order or direction in the nature of Mandamus commanding the respondents to forthwith finalize and disburse all the retiral dues of the petitioner, including pension, gratuity and all other admissible post- retiral benefits, which have become due and payable from the date of his superannuation, i.e., 31.07.2020, together with interest at such rate as this Hon’ble Court may deem fit and proper, in view of the arbitrary, unjustified and prolonged delay in releasing the same. B. Issue a writ, order or direction in the nature of Mandamus commanding the respondents to forthwith compute and release the entire arrears of pension payable to the petitioner from the date of his superannuation, i.e., 31.07.2020, along with interest at such rate as this Hon’ble Court may deem just, equitable and proper.” UKHC010049482026 2026:UHC:6476 (3) Learned State Counsel submits that there are three objections raised by Chief Treasury Officer, Almora, vide letters dated 15.10.2022 and 17.2.2023. He submits that regularisation order passed in respect of petitioner is not traceable, therefore difficulty is being faced in sanctioning the pension to the petitioner. (4) Having regard to the facts of the case, writ petition is disposed of with a direction to Commissioner, Food and Civil Supplies to personally look into the matter and to ensure that pension and other retiral dues are released in favour of petitioner as early as possible, but not later than six weeks from the date of presentation of certified copy of this order. If any document is required from the petitioner, then it shall be open to the authorities of the Food and Civil Supplies Department to request the petitioner to furnish such document and it shall be incumbent upon the petitioner to submit whatever document he is required to submit, within one week from the date of receiving request therefor.
