Petitioner is an association formed by vegetable vendors, who market their produce regularly at a place called 'Santhe Maidana' in Kolar town. 2. On the ground that certain persons are illegally trying to prevent the vegetable vendors from doing their business at 'Santhe Maidana', the petitioner/association made a representation to respondent no.3 to maintain the said 'Santhe Maidana' in proper order and also provide facilities for vegetable vendors marketing their produce thereunder. As no action was taken subsequent to making the representation, the present petition is filed with the following prayers: "1. Call for the entire records in respect of Sy.No.189 of Santhe Maidana, Kolar. 2. Issue writ in the nature of Mandamus/directing the Respondent No.3 to consider the representation/compliant at Annexure-K dated 17.02.2022 and to take immediate steps to protect and safeguard 'Santhe Maidana' a common man market in the Kolar Town functioning since 1939. Further to provide infrastructures by the Respondent No.3 in - 4 - HC-KAR NC: 2026:KHC:14373 WP No. 11073 of 2022 providing drinking water supply, electricity, toilets and shelters; 3. Pass such other order/s as this Hon'ble Court deems fit and proper in the circumstances of the case." 3. Respondent No.3 has filed an affidavit dated 10.03.2026, which reads as under: "I, G Navin Chandra, S/o. Narayanappa Gopalakrishna, aged about 51 years, presently working as Commissioner, City Municipal Council, Kolar, having office at Kolar, do hereby solemnly affirm and state on oath as follows: 1. I am the Commissioner of City Municipal Council, Kolar, Respondent No. 3 herein, and I am well acquainted with the facts of the case. Hence, I am competent to swear to this affidavit on behalf of Respondent No.3. 2. I submit that the Petitioner has filed the above Writ Petition seeking a direction against the Respondents to provide basic infrastructure facilities such as drinking water, electricity, toilets, and shelters for vendors, villagers, and the general public at Sandfield/Santhemaidan situated in Kolar Town. 3. I respectfully submit that a meeting was convened under the chairmanship of the present Administrator of CMC, Kolar, the Deputy Commissioner, Kolar, in the - 5 - HC-KAR NC: 2026:KHC:14373 WP No. 11073 of 2022 presence of me as the Commissioner, CMC, Kolar, and other concerned officials to consider the development of Santhemaidan. 4. It is submitted that in the said meeting, a decision was taken to allocate budgetary provisions for the development of Santhemaidan, (which presently measures approximately 22 guntas) by providing necessary infrastructure facilities including drinking water, electricity, toilets, and shelters for vendors, villagers who come to sell their products and the general public. The present extent off the said land measures approximately 22 guntas, and in the said meeting a sum of Rs.1,50,00,000/- (Rupees One Crore Fifty Lakhs only) was proposed to be allocated for the development of the same, subject to availability of funds. The said development is expected to require approximately one year for completion. 5. I further submit that the above decision and information were duly intimated to the learned counsel for the Petitioner through Speed Post letter dated 05.02.2026. 6. In view of the above steps taken by us as the Respondents in the above case, the grievance raised by the Petitioner does not survive for consideration, as necessary action has already been initiated. 7. Hence, it is respectfully prayed that this Hon'ble Court may be pleased to dispose of the above Writ Petition in the interest of justice and equity - 6 - HC-KAR NC: 2026:KHC:14373 WP No. 11073 of 2022 I, the deponent above named, do hereby verify that the contents of paragraphs 1 to 7 are true and correct to the best of my knowledge, information and belief." 4. Learned counsel for respondent no.3 submits that steps will be taken to protect 'Santhe Maidana' and also provide better facilities for the vegetable vendors, who trade in the said place. 5. For the aforementioned reasons, the writ petition is disposed of with a direction to respondent no.3 to do the needful as undertaken by him in his affidavit dated 10.03.2026 which is extracted in paragraph No.3 supra. 6.
