1. Mr. Harshpal Sekhon, learned counsel for the applicant.
2. Mr. Pratiroop Pandey, learned A.G.A. for the State.
3. The present applicant ‘Mohit Sahra’ S/o Rakesh Kumar is seeking bail in reference to First Information Report dated 06.04.2026 bearing FIR No. 61 of 2026 P.S. Pantnagar, District Udham Singh Nagar, wherein, the present applicant along with three others have been implicated for the offences punishable under section 3, 4, 5, 6 of Immoral Traffic (Prevention) Act, 1956, P.S. Pantnagar, District Udham Singh Nagar.

It is submitted by the learned counsel for the applicant that the present applicant is innocent and has been falsely implicated and in fact he was serving simply as a worker in the SPA Center and two other co-accused persons have already been enlarged on bail by the Trial Court. He further submits that the present applicant is languishing in jail since 06.04.2026 and the charge-sheet has already been filed. He further submits that all the offences are triable by Magistrate and there is no previous criminal antecedent of the applicant.

On the other side, Mr. Pratiroop Pandey, learned A.G.A. have not disputed that the other two co-accused have already been enlarged on bail by the Trial Court and the applicant has no previous criminal history and also submits that the charge-sheet has been filed. He also submits that the offences are triable by the Magistrate.

6. After hearing the arguments of learned counsel for the parties and taking into
consideration that the other two co-accused have been enlarged on bail and the charge-sheet has been filed and the applicant has no previous criminal history and the offences are triable by the Magistrate, this court is of the view that the applicant deserve for bail.
7. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.
8. Let the applicant ‘Mohit Sahra’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
