1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 85/2026 registered at Police Station Ramganj District Ajmer for the offences under Sections 8/21, 8/22 of NDPS Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated for the offence under Section 8/21 of NDPS Act read with Section 29 of the NDPS Act. The recovered quantity of smack and MD from the other co- accused was 33.32 grams and 9.50 grams respectively and the same falls within the ambit of commercial quantity. It is further contended that there is no substantial evidence on record indicating petitioner's involvement in the alleged offence apart from disclosure statement of other co-accused. It is also
[2026:RJ-JP:23837] (2 of 2) [CRLMB-8721/2026] contended that there are no criminal antecedents against the accused petitioner and further trial/investigation of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application.
4. Heard and perused the material available on record.
5. Considering the arguments advanced by the learned counsel for the petitioner and the fact that trial/investigation of the case may take considerable time, therefore, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Neetu Bhogawat W/o Shyam Bhogawat, in connection with FIR No. 85/2026 registered at Police Station Ramganj District Ajmer shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for her appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
