THIS WRIT PETITION IS LISTED FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, AN ORDER IS MADE AS UNDER: ORAL ORDER Sri.S.Rajesh., counsel for the petitioner and Sri.H.V.Devaraju., counsel for the respondents have appeared in person. 2. The captioned Writ Petition is filed seeking following reliefs: A. Issue a writ in the nature of certiorari quashing the impugned power order sanction bearing No.MESCOM/544/17/09-2024 dated:17.09.2024 at ANNEXURE-A2 in so far as it relates to Sl.No.5 of the tariff details amount of Rs.58,500/- has been levied as development charges on the Petitioner, under the facts and circumstances of the case; B. Issue a writ in the nature of certiorari quashing the impugned endorsement bearing No.AEE[E]/Ullala.SAEO[Tq]/25-25/5175-76 dated:17.12.2024 at ANNEXURE-D issued by the 3rd - 3 - HC-KAR NC: 2026:KHC:8287 WP No. 13731 of 2025 respondent, under the facts and circumstances of the case; C. Issue a writ in the nature of mandamus directing the 3rd respondent to give power connection to the Petitioner's residential building at No.2-193/3/5 of Arasunagar Cross road, Madoor Kotekar village of Ullal taluk of South Canara, without insisting the developmental charges, under the facts and circumstances of the case; and D. Issue any other appropriate writ, order or orders or direction as this Court may deems fit to grant under the facts and circumstances of the case, in the interests of justice. 3. A perusal of the petition averments and the reliefs sought by the petitioner depicts that it is disputed questions of fact and the same cannot be accorded under Writ jurisdiction. However, a liberty is accorded for the petitioner to approach Karnataka Electricity Regulatory Commission (Consumer Grievance Redressal Forum and Ombudsman) Regulations, 2004 seeking appropriate relief in accordance with the law, if so advised within two weeks from the receipt of certified copy of this order. From the date of the complaint that would be filed by the petitioner, the Karnataka Electricity Regulatory - 4 - HC-KAR NC: 2026:KHC:8287 WP No. 13731 of 2025 Commission (Consumer Grievance Redressal Forum and Ombudsman) Regulations, 2004 is directed consider the grievance and pass suitable orders within three months thereon.
