Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case being the owner of a godown which was let out to other persons. It has been further submitted that there are no materials to connect the present petitioner with the offence alleged and he is in custody since 02.04.2025.
Learned advocate for the State, on the other hand, submits that 103.4 Kgs. of Ganja were recovered from 4 vehicles and one of the vehicle happens to be that of the wife of the petitioner, apart from the fact that the godown belongs to the present petitioner.

State has also submitted that there are antecedents of the present petitioner.
Having regard to the facts of the present case I am of the view that the provisions of Section 37 of the NDPS Act is attracted.
As such, the prayer for bail of the petitioner in CRM (NDPS) 140 of 2026 is dimissed.
Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
