The petitioner is apprehending his arrest in connection with Complaint (Forest) Case No. 88 of 2024, registered for the offence under Sections 30(a), 30(c) and 33 of Indian Forest Act, pending in the court of learned Additional Chief Judicial Magistrate, Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that false allegation of levelling of the forest land is made, however, the said land is of the petitioner, which was obtained by the ancestors of the petitioner on the basis of Hukumnama in the year 1944. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that even the boundary wall has been erected. 5. Considering that the dispute is with regard to land and boundary wall, however, the said land was obtained by the ancestors of the petitioner on the basis of Hukumnama in the year 1944, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
